The moot case borrowed elements from recent events involving Ukraine, Russia and Crimea, which raise questions of secession and annexation of territory, effective control and use of force under public international law.
Both sides – the investor and the state – addressed these issues before the tribunal to determine whether the investor qualified for protection under the bilateral investment treaty.
The case dealt with a claim for compensation for indirect expropriation of assets. The investor, an arms manufacturer, claimed that its investment was nullified by certain measures taken by the host state in response to the territorial dispute.
A team from NALSAR University of Law Hyderabad placed second. Two teams from the National Law Institute University (NLIU) Bhopal and National Law University (NLU) Jodhpur also made it to the finals.
Varsha Sriram from NLIU Bhopal was awarded best overall speaker while Parul Mehra from NLS Bangalore was judged the best speaker in the finals. NLIU Bhopal and NLU Jodhpur jointly took the best claimant memorial award and NLU Odisha claimed the best respondent memorial award.
The top four teams will go on to compete in the global round in Buenos Aires from 3-6 November, administered by the Center for International Legal Studies, Salzburg. The teams will receive sponsorships from the international organizers towards their travel and stay.
