US publisher wins India copyright case

Indian law firm Akash Chittranshi & Associates acted for US publishing company Houghton Mifflin Harcourt in a successful civil proceeding against All India Traveller Book Seller (AITBS). The action followed police raids that uncovered thousands of pirated textbooks.

Boston-based Houghton Mifflin Harcourt is an education publisher with annual revenue of approximately US$2.5 billion. It took the action under Sections 63 and 65 of the Indian Copyright Act for infringement, and Sections 420 and 120-B of the Indian Penal Code for cheating and criminal conspiracy.

The court found in favour of Houghton Mifflin Harcourt. It issued a permanent injunction against AITBS and ordered a satisfactory payment in settlement of all claims. A criminal case filed against AITBS ended in early January.
