Sony BMG Taiwan has issued a legal notice to filmmaker Tips Industries, alleging that the music composition of the song Zara Zara Touch Me from the Hindi film Race is a copy of the song Deep in the Bamboo Grove by Taiwanese artist Wang Lee Hom. Alleging infringement, Sony, which owns the rights to Wang’s song, has sought NT$10 million (US$314,890) in damages from Tips, which hired Chakraborty for the composition.
Similar allegations have been made against other music composers in the past. Most recently, as reported in the June issue of India Business Law Journal, musician Ram Sampat sued filmmaker Rakesh Roshan for infringing the copyright of his composition The Thump, which he claimed was used by Roshan in two songs in the film Krazzy 4. Although the defendant had obtained a certificate of no objection from Sony Ericsson, Sony’s licensee rights to the composition had expired. The parties reached a last minute out-of-court settlement with Sampat receiving Rs20 million (US$400,000) from the defendants.
