Since its establishment, the Beijing Arbitration Commission (BAC) has accepted cases regarding investment and finance at a steady rate. In 2011, the commission accepted 135 cases regarding investment disputes, accounting for 9.2% of all cases, while in 2012, it accepted 128 cases regarding investment disputes, or 8.7% of all cases. These numbers in the two successive years put such disputes in the top five of all case types.
By analysing the practical handling of cases, the following characteristics of arbitration meet the needs of resolving investment and financial disputes.
Professional trial. The parties can choose professional arbitrators acquainted with industrial practice and development. These insiders hold a more active attitude towards innovative financial products and respect the business arrangement and market needs of the parties. The arbitration tribunal ensures that laws are not applied inflexibly, taking into account the practice of the investment and financial industry. According to incomplete statistics, there are 78 arbitrators with Chinese nationality and 31 with foreign nationality in the investment and financial field at the BAC.
